Sussex University Overturns £585,000 Free Speech Fine In High Court Ruling

The University of Sussex has successfully overturned a record £585,000 fine after the High Court ruled the decision against it was flawed.
The penalty was issued in March 2025 by England’s university regulator, the Office for Students (OfS), which claimed the university had failed to uphold freedom of speech through its trans and non-binary inclusion policy.
However, a High Court judge has now found significant issues with how the regulator reached its decision.
The ruling said the OfS had taken a flawed approach and appeared to have “closed its mind” to alternative outcomes during its investigation.
The case followed controversy surrounding former philosophy professor Kathleen Stock, who left the university after protests over her views on gender.
The court did not rule on her case directly, but instead focused on whether the regulator followed a fair process when issuing the fine.
The University of Sussex welcomed the decision, saying it reaffirmed its commitment to academic freedom and free speech.
The OfS said it was “disappointing” and is now considering whether to appeal the ruling.
